GENERAL CONDITIONS FOR USE OF THE APARTMENT BY GUESTS

Designation of terms:

Guest - a natural or legal person who is a party to an agreement for the temporary use of residential premises (apartment rental agreement for a holiday or tourist stay), at the disposal of TUTU Kraków.

Apartment – residential premises, described in detail in the offer presented on the TUTU Kraków website, which the Guest rents for a temporary stay for recreational or tourist purposes.

TUTU Kraków – Aktiv Group Sp. z o. o., entered into the Central Registration and Information on Economic Activity kept by the minister responsible for economy and maintaining the Central Registration and Information on Economic Activity,

§ 1 SUBJECT OF THE REGULATIONS

  1. These regulations define the subject of the provision of liability services and the stay on the premises of TUTU Kraków and are an integral part of the contract, which is concluded by making a reservation, paying the reservation fee or the entire amount due for the stay at the facility. By performing the activities listed in the previous sentence, the Guest confirms that he or she has read and accepts the terms of the Regulations
  2. The Regulations apply to all persons staying on the premises of TUTU Kraków in Kraków.
  3. The regulations are available in each apartment.

§ 3 TECHNICAL REQUIREMENTS

  1. For the proper functioning of the website you need:
    • Internet access,
    • standard operating system,
    • standard web browser
  2. To make a reservation on the TUTU Kraków website, in addition to the requirements specified in section 1, an active email account is required.

§ 4 DANE OSOBOWE I PLIKI COOKIES

  2. The administrator of personal data provided by the Guest when using the website tutukrakow.pl is TUTU Kraków. Detailed information regarding the processing of personal data by TUTU Kraków - including other purposes and grounds for data processing, as well as data recipients - can be found in the Privacy Policy available on the website - due to the principle of transparency contained in the general regulation of the European Parliament and of the Council (EU) on data protection – "RODO”.
  3. The purpose of processing Guest data by TUTU Kraków, provided by the Guest in connection with the reservation on the website, is to complete the apartment reservation. The basis for the processing of personal data in this case is:
    1. contract or actions taken at the Guest's request aimed at concluding a reservation (art. 6 ust. 1 lit. b RODO),
    2. legal obligation of TUTU Kraków related to accounting(art. 6 ust. 1 lit. c)
    3. the legitimate interest of TUTU Kraków, consisting in the processing of data in order to establish, pursue or defend possible claims(art. 6 ust. 1 lit. f RODO).
  4. Providing data by the Guest is voluntary, but at the same time necessary to conclude the contract. Failure to provide data will prevent the conclusion of a contract on the TUTU Kraków website.
  5. Guest data provided in connection with the reservation on the website will be processed until:
    1. the contract concluded between the Guest and TUTU Kraków will cease to be valid;
    2. TUTU Kraków will no longer have a legal obligation to process the Guest's data
    3. the Guest or TUTU Kraków may no longer be able to pursue claims related to the contract concluded via the website;
    4. the Guest's objection to the processing of his or her personal data will be accepted - if the basis for data processing was the legitimate interest of TUTU Kraków - depending on what is applicable in a given case and what will happen at the latest.
  6. The guest has the right to request:
    1. access to your personal data,
    2. their corrections,
    3. deletion,
    4. processing restrictions,
    5. transferring data to another administrator
    as well as the right: to object at any time to the processing of data for reasons related to the Guest's special situation - to the processing of personal data concerning him, based on art. 6 ust. 1 lit. f RODO (i.e. on legitimate interests pursued by the administrator).
  7. In order to exercise their rights, the Guest should contact TUTU Kraków using the data from § 2 of the Regulations.
  8. If the Guest considers that his or her data is being processed illegally, the Guest may submit a complaint to the President of the Office for Personal Data Protection.

§ 5 RESERVATION

  1. Before making a reservation and concluding a rental agreement, the Guest should read these regulations.
  2. Reservations can be made using the IT system, including online, by phone or e-mail.
  3. After booking the apartment online or by e-mail, the guest will receive a form to the e-mail address provided, containing information about the reservation (reservation number, place, time, reservation price, payment method) and confirmation of the reservation. Confirmation of the reservation constitutes the conclusion of the rental agreement.
  4. If the Guest makes a reservation by phone, he or she will receive confirmation of the reservation at the e-mail address provided in the form of a reservation confirmation form containing the following information: place, time, reservation price, payment method. Confirmation of the reservation constitutes binding of the rental agreement.
  5. The apartment can be booked for a period of at least 1 hotel day, which is also the minimum duration of the rental agreement.
  6. In the event of a guest's no-show or cancellation of the reservation by the customer, the customer is responsible for the cost of one day of the reservation, even if payment on the spot is chosen.
  7. The guest may not transfer the apartment or make it available to other people without the consent of the owners of TUTU Kraków, even if the period for which the fee has been paid has not expired.
  8. Persons who are not guests of TUTU Kraków may stay as guests in the Guest's apartment with the consent of the owners of TUTU Kraków.
  9. TUTU Kraków reserves the right to refuse to accept a Guest, including to cancel his reservation, if during the previous stay both the TUTU Kraków Guest and his accompanying persons and visitors grossly violated the Regulations, in particular by causing damage to the property of the apartment or Guests, damage on guests or other people staying in TUTU Kraków apartments.

§ 6 SERVICE FEES AND PAYMENT TERMS

  1. Wysokość opłaty za wynajem apartamentu na pobyt jest każdorazowo podana w formularzu potwierdzenia rezerwacji otrzymanym po dokonaniu rezerwacji lub telefonicznie przy dokonywaniu rezerwacji.
  2. The fee indicated in the price offer on the website and in the reservation form includes tax on goods and services and includes the fee for the stay in the apartment for the number of people specified in the contract along with the usual scope of hotel-related services that are part of the stay. Additional fees and deposits may be added to the rental fee.
  3. The rental agreement does not include cleaning not included in the schedule of TUTU Kraków apartments, additional replacement of linen and towels, rental of a baby cot or the stay of an animal.

§ 7 HOTEL DAY

  1. The apartment is rented for hotel days.
  2. The hotel day starts at 15:00 and ends at 10:00. Any changes to the beginning or end of your stay may be subject to individual arrangements with TUTU Kraków.
  3. The stay ends at 10:00 on the last day of the booked date.
  4. The guest should report the wish to extend the stay beyond the period indicated on the day of arrival no later than 20:00 on the day before check-out from the TUTU Kraków apartment. TUTU Kraków will take into account the request to extend your stay depending on the availability of apartments.
  5. If the Guest does not check out by 10:00 on the last day of stay, the Guest may be charged an additional fee equal to the cost of stay for one day in the rented apartment. Charging this fee does not entitle the Guest to stay in the apartment or extend the concluded lease agreement.
  6. TUTU Kraków reserves the right to refuse to extend the Guest's stay in the apartment in the event of non-compliance with the regulations.

§ 8 SERVICES AND ADDITIONAL SERVICES

  1. TUTU Kraków provides services in accordance with its standard.
  2. In case of any reservations regarding the quality of services, the Guest is asked to immediately report reservations to the owners of TUTU Kraków, which will enable the owners to react and improve the standard of services provided.
  3. If any defects or deficiencies in the equipment are found after entering the apartment, the Guest is obliged to immediately report his/her observations to the owners of TUTU Kraków. Otherwise, you will be charged for the loss and damage.
  4. TUTU Kraków is obliged to provide guests with:
  • conditions for complete and unrestricted rest,
  • safety during the stay, including the security of maintaining the secrecy of information about the Guest,
  • professional and courteous service in all services provided in the apartments,
  • cleaning the apartment and performing necessary repairs of equipment during the guest's absence, and in his presence only if he consents,
  • technically efficient service; and in the event of defects that cannot be removed immediately, the owners of TUTU Kraków apartments will make every effort to replace the apartment or otherwise alleviate the inconvenience, if possible.

§ 9 GUEST RESPONSIBILITY

  1. In TUTU Kraków apartments, children under 12 years of age should be under constant supervision of their legal guardians. Legal guardians will be financially liable for any damage to items of equipment and technical devices resulting from the children's actions.
  2. The guest bears full financial responsibility for all types of damage, destruction and contamination of the equipment and technical devices of the apartment, caused by the fault of visitors. The amount charged will depend on the costs the apartment must incur to restore the damaged items to their original condition.
  3. The guest undertakes to use the apartment in accordance with its intended purpose, not to remove any elements of its equipment and decorations from the apartment, and also undertakes not to copy the apartment cards given to him during his stay.
  4. In the event of violation of the provisions of the Regulations, TUTU Kraków may refuse to provide services to the person who violates them. Such a person is obliged to immediately comply with the hotel's requests, settle the amount due for previous services, pay for any damage and leave the TUTU Kraków apartment.
  5. Each time the Guest leaves the apartment, for safety reasons, the Guest should turn off the TV, turn off the light, turn off the water and check whether the door is closed and take careful care of the apartment card.
  6. Smoking tobacco products, including smoking electronic cigarettes and taking intoxicants is prohibited in the entire TUTU Kraków apartments. TUTU Kraków will indicate places where smoking tobacco products, including electronic cigarettes, will be allowed. A guest who does not comply with the ban will be charged a fee equivalent to the cost of restoring the apartment to its original condition, no less than PLN 200.
  7. The guest is obliged to secure the apartment each time he leaves it by closing the windows and card entrance doors and taking careful care of the cards.
  8. A fee of PLN 10 is charged for losing the access card to the apartment lock.
  9. If unregistered animals are brought onto the premises of TUTU Kraków, both by the Guest and by people visiting TUTU Kraków Guests, the Guest may be charged a fee equivalent to the costs necessary to restore the apartment or other rooms to their initial condition, not less than PLN 400 for each day of presence. animal on the premises of TUTU Kraków.
  10. To secure any claims for damages or fees, TUTU Kraków has the right to collect from the Guest a deposit in the amount of two days' fee for the stay in the apartment at the time of collection of the apartment by the Guest. The deposit is interest-free and refundable after the end of the guest's stay, when the keys to the apartment are returned.

§ 10 RESPONSIBILITY HERE KRAKOW

  1. TUTU Kraków is not responsible for damage or loss of a car or other vehicle belonging to the Guest, items left in it or live animals parked in the above-ground or underground parking lot.

§ 11 RETURN OF ITEMS LEFT

  1. Przedmioty osobistego użytku pozostawione przez wyjeżdżającego Gościa w apartamencie TUTU Kraków będą odesłane na wskazany przez Gościa adres i na jego koszt. W przypadku nie otrzymania takiej dyspozycji Apartments TUTU Kraków przechowa powyższe przedmioty na koszt właściciela przez okres trzech miesięcy, a po upływie tego okresu przedmioty zostaną zutylizowane. Ze względu na swoje właściwości artykuły spożywcze przechowywane będą przez okres 24 godzin. Otwarte artykuły spożywcze oraz leki zostaną niezwłocznie zutylizowane po wyjeździe Gościa.

§ 12 CURFEW

  1. Quiet hours in TUTU Kraków apartments are from 10 p.m. to 10 p.m. 07:00 the next day. The behavior of the Guest and people using the apartment's services should not disturb the peace of stay of other guests. TUTU Kraków may refuse to continue providing services to a person who has violated this rule without refund of the costs incurred for the stay.

§ 13 COMPLAINTS

  1. Guests have the right to submit complaints if they notice any deficiencies in the quality of services provided, in accordance with applicable legal provisions.
  2. The condition for considering a complaint is to submit it in writing to the owners of TUTU Kraków. A complaint should be submitted immediately after noticing any deficiencies in the standard of services provided.
  3. Complaints will be considered within 30 days of their receipt. Information about the result of considering the complaint will be sent to the guest at the e-mail address, postal address or by telephone. If the complaint is upheld, the Guest will receive compensation in an amount proportional to the damage suffered.
  4. Jeżeli TUTU Kraków nie uzna reklamacji Gościa, a ten nie zgadza się z jego decyzją, Gość powinien zwrócić się o mediację do Centrum Mediacji przy Okręgowej Izbie Radców Prawnych w Krakowie w Krakowie. § 14 ADDITIONAL PROVISIONS

  1. Dangerous goods, weapons, ammunition, flammable, explosive or illuminating materials cannot be stored in TUTU Kraków apartments.
  2. Due to fire protection requirements, it is prohibited to use heaters, electric irons and other similar devices that are not part of the apartment's equipment in the apartments.
  3. Apart from a slight rearrangement of furniture and equipment that does not affect their functionality and safety of use, guests are not allowed to make any changes to the apartments and their equipment.
  4. The offer, photos, equipment and amenities of the apartments and the prices given on the website are for information, illustrative and advertising purposes only. The actual condition of the apartment and its rental price are provided in the form received after making the reservation or in a telephone conversation.
  5. The Regulations enter into force on the day of publication on the website.
  6. The Seller reserves the right to change the Regulations. For contracts concluded before the amendment of the Regulations, the version of the Regulations in force on the date of conclusion of the contract shall apply.
